Moetzes Gedolei HaTorah's Gilui Da'as About the Independence of Halacha

The Torah hakedosha was given to us from Hashem. "Moshe received Torah on Sinai and transmitted it to Yehoshua, and Yehoshua to the elders. . ." and since then, until today, the chain of the Torah's transmission from generation to generation has continued without any change, cholilo.

We believe with full faith that "this Torah will not be exchanged, and that there will not be another Torah from the Borei Yisborach Shemo."

Therefore, any intervention of a governmental, public or judicial body in matters pertaining to halocho or Jewish tradition is totally inconceivable.

All intervention of this sort opposes the Torah hakedosha which has been transmitted to us from generation to generation [and such intervention] has no validity.

The foundation of our existence as a nation is, as R' Saadia Gaon has explained, "Our Nation is not a Nation except by means of its Torah" -- the written Torah and the oral Torah. We are assured that "any device which besets you will not succeed, and any tongue which rises up against you in the law, will be condemned."
