Hatzofeh Article Against Gedolei Yisroel

by E Rauchberger

The brazen remarks against gedolei Yisroel published in Hatzofeh two weeks ago, "are not appropriate for handling in the criminal sphere and do not constitute a criminal violation of the law," Justice Minister Livni told the Knesset plenum, quoting a response by Attorney-General Mani Mazuz to a complaint filed by MK Rabbi Moshe Gafni against Hatzofeh and the writer who penned the highly objectionable article.

Minister Livni emphasized that her opinion was given only from a legal standpoint and "of course anyone affected by the article reserves the right to file a claim based on the law prohibiting libel, including a criminal complaint."

MK Rabbi Gafni said he disagreed with the answer and in any event he intends to continue addressing the issue, not allowing it to fall off the agenda unless the writer prints a retraction. "There is also a halachic obligation to object to what he wrote, as it says in maseches Ovos: `Hizoharu begachalason shel talmidei chachomim.'"
